Approve an Inclusionary Housing Plan and Agreement authorizing payment of an in -lieu fee. <br />PLANNING COMMISSION ACTION <br />On October 14, 2013, the Planning Commission recommended that the City Council approve and <br />adopt the Mitigated Negative Declaration and Mitigation Monitoring Program, Environmental Review <br />No. 2013 -14; adopt an ordinance approving Zoning Ordinance Amendment No. 2013 -03; and adopt <br />a resolution approving Site Plan Review No. 2013 -05 as conditioned by a vote of 6:1 (Yrarrazaval <br />dissenting) to allow the construction of a multi - family residential project with 182 units at 301 East <br />Jeanette Lane. The Planning Commission made no changes to the recommendations and <br />conditions outlined in the attached staff report (Exhibit A). <br />DISCUSSION <br />In addition to the actions taken by the Planning Commission, the applicant has requested to satisfy <br />the Housing Opportunity Ordinance by payment of a one -time fee. The Housing Opportunity <br />Ordinance allows payment of a fee if substantial evidence supports that the cost of providing <br />inclusionary units on -site would substantially exceed the amount of the in -lieu fee. The amount of <br />the fee is based on the affordability gap associated with fulfilling the required affordable housing <br />7501-1 <br />
