Low Income Households shall be the amount published by HCD as adjusted to <br />reflect the household size of the Homebuyer of the Inclusionary Unit. <br />Market Rate Unit means any unit in the project that is not restricted for <br />ownership and occupancy by Eligible Purchaser. <br />Moderate Income Household refers to households whose income meets the <br />standards defined Title 25 of the California Code of Regulations Section 6932, <br />and by the HSC Section 50093. The maximum household income amount for <br />Moderate Income Households shall be the amount published by HCD as <br />adjusted to reflect the household size of the Homebuyer of the Inclusionary Unit. <br />Ordinance means the Housing Opportunity Ordinance adopted by the City <br />Council on November 28, 2011 as it has been amended from time to time, which <br />is codified in the Santa Ana Municipal Code. <br />Party and Parties mean the City and the Developer as parties to this <br />Inclusionary Housing Agreement. <br />Project means the housing project proposed to be developed on the Property at <br />the Developer's sole cost and expense. <br />Property means the real property on which the Project is to be developed, for <br />which the legal description is provided in Exhibit A to this Inclusionary Housing <br />Agreement. <br />ARTICLE 1 <br />PARTIES; REPRESENTATIONS AND WARRANTIES; EFFECTIVE <br />DATE; RECITALS; AND EXHIBITS <br />I.
