Appropriation Adjustment and <br />Contract Award for Festival Hall <br />Restroom Improvements (Project 2741A) <br />December 20, 2004 <br />Page 2 <br />DISCUSSION <br />Due to close proximity of Olson Loft project and Festival Hall on <br />Sycamore and Second Streets, a noise mitigation of Festival Hall was <br />required which consisted of replacement of windows and doors with sound <br />transmission class rating in compliance with City's noise ordinance. In <br />addition an air conditioning system needed to be installed since the <br />doors and windows were to be closed during operating hours. <br />Olson Company was conditioned to fund $286,000 for noise mitigation. An <br />agreement was executed between the City and Festival Hall to construct <br />the noise mitigation improvements prior to occupancy of the lofts. <br />During the plan check process, the City realized that restroom <br />accessibility is required to comply with California Building Code. The <br />noise mitigation improvements were constructed as Phase I to meet the <br />occupancy schedule for the Olson Loft project. <br />In order to comply with California Building Code requirement, Phase II <br />improvements for Festival Hall project are required to address restroom <br />accessibility. Restroom improvements were not part of the original <br />scope of the noise mitigation and not conditioned on Olson Company. <br />Instead this became an obligation of the Redevelopment Agency per the <br />agreement between the City and Festival Hall. <br />The Notice Inviting Bids was advertised on September 15 and 17, 2004, and <br />bids were opened on October 6, 2004.
