91 <br />VII. REPORT AND RECOMMENDATION OF THE PLANNING COMMISSION AND THE <br />COMMUNITY REDEVELOPMENT & HOUSING COMMISSION <br />Planning Commission <br />Section 33352(h) of the CRL requires that the Agency's Report to the City Council contain the <br />report and recommendations of the Planning Commission on the proposed Amendment. <br />Section 33352 Q) of the CRL requires that the Agency's Report to the City Council contain the <br />report required by Section 65402 of the Government Code. Section 65402(c) states among <br />other things, that no real property should be acquired by dedication or otherwise for public <br />purposes, no real property shall be disposed of, no street shall be vacated or abandoned and no <br />public building or structure shall be constructed or authorized until such activities have been <br />submitted to and reported upon by the local planning agency as to conformity with the <br />jurisdiction's adopted general plan. <br />On May 24, 2004, the Planning Commission of the City of Santa Ana received the proposed <br />Amendments. The Planning Commission has 30 days within receiving the Amendments to <br />make and file its report and recommendations with the Agency. On June 14, 2004, the Planning <br />Commission adopted their report regarding the consistency of the proposed Amendments with <br />the City's General Plan and recommended that the Agency and City Council adopt the proposed <br />Amendments. The Planning Commission's report regarding the consistency of the proposed <br />Amendments with the General Plan, and the recommendations on the proposed Amendments <br />are included within this Report as Appendix B. <br />Community Redevelopment and Housing Commission <br />As part of its duties, the Community Redevelopment and Housing Commission provides <br />recommendations to the Agency Board on the adoption of redevelopment plans and plan <br />amendments. The Commission has been involved with the Amendments' adoption process <br />including reviewing the Preliminary Report and the draft Amendments on March 2, 2004 and <br />recommending that the Agency Board approve these documents. On June 15, 2004, the <br />Commission having reviewed the Report to the City Council recommended approval of this <br />Report in draft form including the Initial Study /Negative Declaration, receipt of the Amendments <br />and consenting to the joint public hearing. The specific recommended actions were: <br />That the City Council adopt a resolution receiving the Report to the City Council <br />including the Initial Study /Negative Declaration; receive the Amendments merging the <br />six Redevelopment Projects; and set the date and time for a joint public hearing with the <br />Community Redevelopment Agency with respect to the proposed plan amendments for <br />the merger of the Santa Ana Redevelopment Project Areas and the Initial <br />Study /Negative Declaration prepared in connection therewith. <br />Page 52 of 190 <br />Report to the City Council for the Merger of the <br />Santa Ana Redevelopment Projects <br />PA0403012.8NTA:CK:gbd <br />19090.001004/06 /28/04 <br />Keyser Marston Associates, Inc. <br />Page 41 <br />
