0262Q13 <br />N- 2005 - 078 -001 <br />SAP'S (2) <br />sam M. <br />(Chris FIRST AMENDMENT TO AGREEMENT FOR DETENTION IN <br />SANTA ANA CITY JAIL OF PERSONS TAKEN INTO CUSTODY <br />BY THE IRVINE POLICE DEPARTMENT <br />THIS FIRST AMENDMENT TO AGREEMENT FOR DETENTION <br />IN SANTA ANA CITY JAIL OF PERSONS TAKEN INTO CUSTODY <br />BY THE IRVINE POLICE DEPARTMENT is entered into on October oe?, <br />2013, by and between City of Irvine, a charter city and municipal <br />corporation organized and existing under the Constitution and laws of the <br />State of California ( "Agency ") and the City of Santa Ana, a charter city and <br />municipal corporation organized and existing under the Constitution and <br />laws of the State of California ( "City "). <br />RECITALS <br />A. The parties entered into the original Agreement# N- 2005 -078 on June 13, <br />2005 (hereinafter "Agreement ") by which City has housed Agency's <br />female detainees held in the custody of the Irvine Police Department for <br />violation of Penal Code section 647(f) being under the influences of <br />alcohol, drugs or other controlled substance. <br />B. hz accordance with the terms and conditions of said Agreement, the <br />parties wish to amend the compensation of the Agreement to provide for <br />an increase in the daily jail rate per prisoner per day to more accurately <br />reflect the actual costs to the City of providing such services. <br />WHEREFORE, in consideration of the covenants contained in said <br />Agreement, and subject to all the terms and conditions of said Agreement, <br />except those amended in this First Amendment to Agreement, the parties <br />agree as follows: <br />L Section 3.a., COMPENSATION, shall be amended to increase the daily <br />jail rate from eighty -two ($82.00) dollars a day to ninety ($90.00) dollars <br />a day per prisoner. <br />2. Except as hereinabove amended, all terms and conditions of said <br />Agreement shall remain in full force and effect. <br />Is <br />
