(jxs 12- 26 -13) <br />RESOLUTION NO. 2014 -XXX <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA LEVYING AN ASSESSMENT FOR THE <br />DOWNTOWN SANTA ANA BUSINESS IMPROVEMENT <br />AREA FOR CALENDAR YEAR 2014 <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />A. On February 6, 1984, the City Council, by Ordinance No. NS -1715, <br />established the Downtown Santa Ana Business Improvement Area <br />pursuant to California Streets and Highways Code Sections 36500, et seq. <br />(the "BID Law "). <br />B. On December 16, 2013, the City Council received the 2014 Annual Report <br />for the Downtown Santa Ana Business Improvement Area (the `Report'). <br />C. On December 16, 2013, the City Council adopted Resolution 2013 -xxx <br />approving the Report and setting a public hearing for January 7, 2014 at <br />which time protests could be made to the proposed levy of the 2014 <br />annual assessment for the Downtown Santa Ana Business Improvement <br />Area (the "Annual Assessment'). <br />D. On January 7, 2014, at the time and place called for in Resolution 2013 - <br />XXX, the City Council conducted a duly noticed public hearing at which <br />written and oral protests to the proposed Annual Assessment were made <br />and considered as provided in Streets and Highways Code section 36524 <br />and 36525. <br />E. Qualifying written protests constituting a majority of the owners of the <br />businesses paying the Annual Assessment were not received at or before <br />the conclusion of the public hearing. <br />Section 2. The Report is confirmed and the levy of an assessment for the <br />calendar year 2014 is hereby affirmed in accordance with the assessment formula <br />described in Attachment B of the Report.
