REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />JANUARY 21, 2014 <br />TITLE: <br />ADOPT ORDINANCE TO ALLOW FOR <br />CAMPAIGN DISCLOSURE E- FILING <br />CITY MANAGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 1" Reading <br />❑ Ordinance on 2ntl Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Adopt an ordinance amending Chapter 2 of the Santa Ana Municipal Code by adding Section 2- <br />110 relating to campaign disclosure filing methods. <br />BACKGROUND <br />The City of Santa Ana entered into an agreement with Westcoast Online Information Systems, <br />Inc. dba, NetFile to develop and maintain an electronic filing system for campaign disclosure and <br />statements of economic interest forms. <br />The Clerk of the Council hereby recommends approval of an ordinance that will allow filers to <br />electronically file campaign disclosure statements beginning with forms due January 31, 2014. <br />Prior to allowing electronically filed campaign statements, City Council needs to adopt an <br />ordinance approving the use of online or electronic filing on a system that will operate securely <br />and effectively and will not unduly burden filers. The system should also meet all the <br />requirements stated in AB2452, which the Netfile system does. <br />Filers will have the option to 'opt in" and file electronically or continue to file hard copies with the <br />filing official, aka the Clerk of the Council. If a filer 'opts in" after electronically filing one time, <br />they will be required to electronically file all documents in the future. <br />On January 1, 2013, Assembly Bill 2452 went into effect adding Government Code 84615 which <br />allows a local government agency to require an elected officer, candidate, committee, or other <br />person to file statements, reports, or other documents online or electronically with a local filing <br />officer. AB2452, prescribes criteria that must be satisfied by a local government agency to require <br />online or electronic filing of statements, reports, or other documents. The system must be <br />available free of charge to filers and the public for viewing filings, and must include a procedure <br />50A -1 <br />
