ZONING ADMINISTRATOR HEARING <br />MINUTES <br />NOVEMBER 4, 2009 <br />CONDITIONAL USE PERMIT NO. 2004 -21 <br />4:14 P.M. <br />Mr. Vince Fregoso, Zoning Administrator, called to order the public hearing in the City Hall <br />Ross Annex Conference Room 2001. <br />Also in attendance were: Principal Planner Sergio Klotz, Ben Kaufman, SAPD Mike McCoy, <br />SAPD Yolanda Pena, applicants Justin Reuter and Joey Mendes, Matt Foulkes, Vicky <br />Baxter, Nicholas Lynn, Phil Bacerra, Allegra Fulcher, Chris Alfare, Phil Nisco, and <br />Recording Secretary Martha Ramirez. <br />Principal Planner Sergio Klotz presented the staff report and recommendation. <br />No written communications were received. The public hearing was opened. <br />Public speaking in support of having rear door to alley opened during hours of operation: <br />Allegra Fulcher, Phil Bacerra, Vicky Baxter, Nicholas Lynn and applicants Joey Mendes and <br />Justin Reuter. <br />The public hearing was closed <br />Mr. Fregoso adopted a resolution approving modifications to Conditional Use Permit No. <br />2004 -21 (1) allowing a cover charge, serving draft beer, allowing bottle service, advertising <br />or signs indicating the availability of alcohol, expansion into the basement level and allowing <br />the hours of operation from 11:00 a.m. to 2:00 a.m. as conditioned. (2) Adopt a resolution <br />denying modifications to Conditional Use Permit No. 2004 -21 pertaining to dancing, outdoor <br />patio area and an open rear door. <br />The following modifications were also noted: <br />Police Condition No. 2 delete "except an adjacent outdoor area" replaced with "including the <br />adjacent outdoor area." <br />Modified Police Condition No. 24 to read: "The rear door shall be kept closed at all times <br />during the operation of the premises except in cases of emergency and to permit deliveries. <br />Said door not to consist solely of a screen or ventilated security door" and deleted Condition <br />No. 35 as it was combined with Condition No. 9 (a). <br />The hearing adjourned at 4:58 p.m. <br />Martha Ramirez <br />Recording Secretary <br />mAzoning administration \minutes\2009 \11 -4 -09 cup 04- 21.doc <br />
