ZONING ADMINISTRATOR HEARING <br />MINUTES <br />JULY 29, 2009 <br />CONDITIONAL USE PERMIT NO. 2009 -13 <br />10:37 a.m. <br />Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall <br />Ross Annex Conference Room 2001. <br />Also in attendance were: Leticia Aguilar; Applicant, Carlos Guaman, El Triunfo <br />Corporation, Oscar Villa, applicant's husband, Virginia Avila, Flower Park Neighborhood <br />Association, Toney Trujillo, Alejandro Flores, Assistant Planner II, Yolanda Pena & Mike <br />McCoy, Police Department, and Martha Ramirez, Recording Secretary. <br />Alejandro Flores presented the staff report and recommendation. <br />There were no written communications. <br />Public members speaking in support of the project: Virginia Avila, Toney Trujillo, Oscar <br />Villa, Carlos Guaman and Leticia Aguilar. <br />Zoning Administrator Klotz reviewed the criteria for denial: the premise located within <br />1,000 feet of another existing off - premise license location as well as located within <br />1,000 feet of school, church and park. The premise was determined to be over - <br />concentrated by the State Department of Alcoholic Beverage Control. <br />The Zoning Administrator adopted a resolution denying Conditional Use Permit No. <br />2009 -13. Mr. Klotz offered the option to appeal to the Planning Commission and <br />reviewed the appeal process and timeline with the applicant. <br />SAPID Officer McCoy stated that the ABC license remains with the property not the <br />applicant and /or owner. <br />No public comments were made. <br />The hearing adjourned at 11:13 a.m. <br />y <br />Martha Ramirez <br />Recording Secretary <br />mr\zoning administration \minutes \2009 \07 -29 -09 cup09 -13 <br />
