REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />FEBRUARY 4, 2014 <br />TITLE: <br />CONDITIONAL USE PERMIT NO. 2013 -46 FOR A <br />TYPE 41 ALCOHOLIC BEVERAGE CONTROL <br />LICENSE FOR CURRY HOUSE RESTAURANT AT <br />131 EAST MEMORY LANE - HOUSING FOODS <br />AMERICA CORPORATION, APPLICANT <br />r <br />CITY MAW9GER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />12-112001101 <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 1 s` Reading <br />❑ Ordinance on 2nd Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Receive and file the staff report approving Conditional Use Permit No. 2013 -46 as conditioned. <br />PLANNING COMMISSION ACTION <br />On January 13, 2014, the Planning Commission adopted a resolution approving Conditional Use <br />Permit No. 2013 -46 as conditioned by a vote of 6:0 (Alderete absent) to allow a Type 41 <br />Alcoholic Beverage Control license in order to sell beer and wine for on- premise consumption at <br />the Curry House restaurant located at 131 East Memory Lane in the Specific Development No. <br />59 (SD -59) zoning district. The Planning Commission added a condition that the sale of <br />alcoholic beverage for consumption off the premises is strictly prohibited, as outlined in the <br />attached staff report (Exhibit A). <br />DISCUSSION <br />The Curry House restaurant is a new full service, sit -down restaurant within City Place <br />commercial center. The restaurant is at 131 East Memory Lane, within a recently renovated <br />2,187 square foot tenant space.
