LEASE AGREEMENT <br />1. PARTIES. <br />REL: 9/27195 <br />This Lease is made and entered into this day of <br />19 45 by and between the COMMUNITY REDEVELOP- <br />MENT AGENCY OF THE CITY OF SANTA ANA, a public body, corporate and <br />politic, (hereinafter referred to as "Landlord ") and CALIFORNIA <br />STATE UNIVERSITY, FULLERTON FOUNDATION, a California nonprofit <br />public benefit corporation (hereinafter referred to as "Tenant "). <br />2. PREMISES <br />(a) Generally. <br />Subject to paragraph (c) below, Landlord hereby leases to <br />Tenant and Tenant hereby leases from Landlord, on the terms and <br />conditions hereinafter set forth, that certain real property and <br />the building and other improvements located thereon situated in the <br />City of Santa Ana, County of Orange, State of California, commonly <br />known as the "Grand Central Building" and located at 200 West <br />Second Street, Santa Ana, California, and described in Exhibit A, <br />attached hereto and incorporated herein (said real property is <br />hereinafter called the "Premises "). Subject to paragraph (c) <br />below, the Premises shall be delivered to the Tenant free and clear <br />of all leases, tenants, or other encumbrances which would interfere <br />with Tenants possession of the Premises. <br />(b) Parking facilities. <br />It is understood and agreed that the Premises do not include <br />any on -site off- street parking facilities. However, this Agreement <br />is conditional upon the execution by the City of Santa Ana of an <br />agreement with the Tenant, or with California State University, <br />Fullerton, for the continuous reservation of thirty (30) parking <br />spaces in the City -owned parking structure on the north side of <br />Third Street, between Broadway and Main Street, for parking <br />Tenant's subtenants in the Premises during the entire term of the <br />lease and any extensions thereof. <br />(c) Temporary exclusion of Deli Lease Area. <br />That portion, if any, of the real property described in <br />subsection (a) of this section which is leased to "Grand Central <br />Deli" shall become part of the Premises only at such time as the <br />current lease expires or is otherwise terminated. Such lease is <br />hereinafter referred to as the "Deli Lease" and the area subject to <br />such lease is referred to hereinafter as the "Deli Lease Area." <br />The rights and responsibilities of the parties to this Agreement <br />
