MI)NANCN ON p <br />WORK MAY PROCEED <br />d EFtK OF COtINCII <br />DATE: 9,3° -/ FIRST EXTENSION OF CONCESSION AGREEMENT <br />TITS FIRST EXTENSION OF CONCESSION AGREEMENT is effective as of January al, <br />2014, by and between Knowlwood Enterprises, a California corporation (=Concessionaire ") <br />and the City of Santa Ana, a charter city and municipal corporation organized and existing under <br />the Constitution and laws of the State of California ("City"), <br />RECITALS: <br />A. The parties entered into the `Concession Agreement"' (# A -2410 -239) dated January 20, <br />2011, (hereinafter "said Agreement") by which Concessionaire has provided food service <br />concessions comparable with high level industry practice at the Santa Ana Zoo at Prentice <br />Park, <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to extend <br />said Agreement for the first of two two -year extensions. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all <br />the terms and conditions of said Agreement, the parties agree as follows: <br />1. Section 3, TERM, shall be extended by the first of two two -year extensions, through January <br />31, 2016. <br />2. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in <br />full force and effect. <br />IN WITNESS WHEREOF, the parties hereto have executed this First Extension to Agreement on <br />the date and year first written above. <br />ATTEST: <br />�,.
