SS <br />N- 2005 - 078 -001 <br />SOD (2) sec m19_� <br />Sam (WonX4R AMENDMENT TO AGREEMENT FOR DETENTION IN SANTA ANA <br />Chr6s 4QVWCITY JAIL OF PERSONS TAKEN INTO CUSTODY BY THE IRVINE POLICE <br />MAR 4 2014 DEPARTMENT <br />THIS FIRST AMENDMENT TO AGREEMENT FOR DETENTION IN SANTA <br />ANA CITY JAIL OF PERSONS TAKEN INTO CUSTODY BY THE IRVINE POLICE <br />DEPARTMENT is entered into on November 30 2013, by and between City of Irvine, a <br />charter city and municipal corporation organized and existing under the Constitution and <br />laws of the State of California ( "Agency ") and the City of Santa Ana, a charter city and <br />municipal corporation organized and existing under the Constitution and laws of the State <br />of California ( "City "). <br />RECITALS <br />A. The parties entered into the original Agreement# N- 2005 -078 on June 13, 2005 <br />(hereinafter "Agreement ") by which City has housed Agency's female detainees held <br />in the custody of the Irvine Police Department for violation of Penal Code section <br />647(f) being under the influences of alcohol, drugs or other controlled substance. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />amend the term, termination provision, and compensation of the Agreement to <br />provide for an increase in the daily jail rate per prisoner per day to more accurately <br />reflect the actual costs to the City of providing such services, set a definitive term for <br />the Agreement and reduce the amount of notice necessary for either party to terminate <br />the Agreement. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />First Amendment to Agreement, the parties agree as follows: <br />1. Section 1.a. TERM shall be amended to reflect that the Agreement ends December 1, <br />2016. <br />2. Section Lb., TERM shall be amended to decrease the amount of notice required by <br />either party to terminate the Agreement without cause from ninety (90) days to thirty (30) <br />days. <br />2. Section I.e., TERM, shall be deleted in its entirety. <br />3. Section 3.a., COMPENSATION, shall be amended to increase the daily jail rate from <br />eighty -two (�0 dollars a day to one hundred and forty -six ($146.00) dollars a day <br />per prisoner. 90. <br />4. Except as hereinabove amended, all terms and conditions of said Agreement shall <br />remain in full force and effect. <br />tb�17rA <br />
