adequate rest, will be allowed to flex their scheduled shift start time up to four <br />hours, with the approval of the employee's immediate supervisor and watch <br />commander, or immediate supervisor and section commander. Alternatively, the <br />employee may be allowed to use up to four hours from his /her "Comp Time <br />Banks" at the beginning of their scheduled shift to ensure adequate rest, <br />An employee whose work shift ends or starts within thirty minutes of a <br />mandatory court appearance shall be compensated for those thirty minutes <br />at an overtime rate. <br />2. Effective on the first day of the pay period following approval of this <br />MOU by the City Council, employees assigned to a Watch 3 who are <br />required to appear in court following the end of his /her shift will have the <br />option of remaining on duty or ending their shift. Employees that continue <br />active duty will be compensated at time and one half while on duty. <br />Employees that end their shift will be unpaid prior to their court <br />appearance. <br />D. Employees who are on call for court during off -duty time, and who are called to <br />testify, will be paid at the overtime rate of time and a half of their regular hourly <br />rate, to include actual travel time from their home to court and back, or until their <br />regularly scheduled shift begins. Travel time will be limited to a maximum of <br />one (1) hour each way. Only that period of time devoted to work will be <br />compensated. Time spent on personal pursuits or other non -work related activity <br />will not be compensated. <br />E. Those employees who have advance notice of their required appearance in court, <br />have arranged an appearance time with the District Attorney's Office, or who <br />otherwise have advance notice of mandatory court appearances, will not be <br />compensated for travel time in any manner. <br />F. Employees who appear in court during off -duty hours may elect to start their <br />normal work shift early as specified herein. <br />G. A subpoenaed employee scheduled to appear in court on City business during off - <br />duty time and placed on standby status by the Police Chief or his authorized <br />representative will be compensated two (2) hours on a straight time basis if he or <br />she is not advised of the cancellation of his or her appearance within five (5) <br />Court business days of said appearance. <br />8.14 Creation of Association Comp Time Bank. <br />A. Any member of the Association who works overtime, or has accrued but unused <br />holidays, can designate that he or she will contribute the value of such time to a <br />bank for use by members of the Association for the purposes and subject to the <br />34 <br />25B -36 <br />
