The Fair Share Contribution may be changed as appropriate by action of the Board in the event that, <br />after the commencement of the fiscal year, additional agencies become subscribers. <br />1.9 "Fiscal Year" means the period dating from July 1 in any given <br />year to and including the 30th of June of the following year. <br />1.10 "Hazardous Material' means any of the following substance(s) or material(s): <br />A. Any material listed in California Labor Code Section 6382(b); <br />B. Any material or substance defined in California Health and Safety Code Division <br />20, Chapter 6.95; <br />C. Any material /waste that is regulated by California Code of Regulations Title 22, <br />Division 4.5; <br />D. Any material listed in Code of Federal Regulations Title 40, Part 261; <br />E. Material specified in California Penal Code Section 11417; and <br />F. Any other material or substance released which is reasonably believed to pose a <br />significant present or potential hazard to human health, safety, property, or the <br />environment, or which is declared a hazardous waste pursuant to local, state or federal <br />law, <br />"Hazardous Materials Emergency" means the release or threatened release of any <br />Hazardous Material. <br />1.12 "Hazardous Materials Emergency Response Plan" means the Orange County <br />Hazardous Materials Area Plan. <br />1.13 "Hazardous Materials Emergency Response Services" means the response to, <br />assessment of, and stabilization of, any Hazardous Materials Emergency, <br />1.14 "Jurisdiction" means, in the case of the Orange County -City Hazardous Materials <br />Emergency Response Authority, the territory served by its Participating Agencies. <br />-5- <br />
