ZONING ADMINISTRATOR HEARING <br />MINUTES <br />MARCH 6, 2013 <br />CONDITIONAL USE PERMIT NO. 2012 -28 <br />11:33 a.m. <br />Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall Ross Annex <br />Conference Room 2001. <br />Also in attendance were: Maher Hawara, Edward A. Barhi, Zaher Hawara, Rick A. Blake and James <br />Maciel, La Plaza Market; David Lopez and Maria Sandoval, Neighborhood Residents; Vince Fregoso, <br />Principal Planner; Mike McCoy and Eileen Greene, Police Department; Ryan Hodge, City Attorney; and <br />Jocelyn Magalona, Recording Secretary. <br />Three written communications from Maria Sandoval, David Lopez and Royal Melcher; and an email <br />from Royal & Julie Melcher were received in opposition to the project. <br />Ms. Sandoval and Mr. Lopez also spoke in opposition to the project. <br />Mr. Fregoso presented the staff report; and noted the neighborhood association unanimously voted to <br />oppose the project at its meeting due to poor site conditions, loitering and crime. <br />The Police Department conducted on -site inspections of the property noting adult magazines were <br />accessible by juveniles, which have since been removed, and wanted to remind the applicants that it <br />creates an operational concern. <br />The Police Department noted Condition No. 20 stating that the parking lot lighting standards be up to <br />code prior to the issuance of a letter of approval to the Alcoholic Beverage Control Board. <br />The Zoning Administrator noted the possibility of a church existing within the 1,000 foot radius of the <br />project. The Police Department noted it would recommend denial if verified to be factual. Staff was <br />asked to research. <br />Mr. Blake noted conflicts with the following conditions: Condition No. 12 — the employment of a licensed <br />security guard would be onerous; Condition No. 16 — the store sells micro -brews and would be out of <br />line with its intended operations; Condition No. 19 — the store operates daily and would limit selling <br />alcoholic beverages from 7:00 a.m. to 11:00 p.m.; and Condition No. 21 — the store has a limited <br />storefront and would have to make alterations to provide cash register visibility from the street. Mr. <br />Blake requested a continuance in order to review the conditions of approval. <br />The Zoning Administrator clarified that the conditional use permit is granted to the property and wants <br />to ensure the code requirements are being met. He also stated his concern should a church exist <br />thereby meeting the definition for overconcentration. <br />The Zoning Administrator continued Conditional Use Permit No. 2012 -28 to March 27, 2013 at 10:30 <br />a.m. at the City Hall Ross Annex, Second Floor Conference Room 2001, 20 Civic Center Plaza, Santa <br />Ana, California 92701. <br />The hearing adjourned at 12:25 p.m. <br />J G ®lyn -Mag ona <br />Recording Secretary <br />m6zahninutes @01313 -6 -13 CUP12 -28 La Plaza MarketABC.min <br />
