ZONING ADMINISTRATOR HEARING <br />MINUTES <br />MARCH 21, 2012 <br />CONDITIONAL USE PERMIT NO. 2012 -05 <br />10:39 a.m. <br />Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall Ross Annex <br />Conference Room 2001. <br />Also in attendance were: Brent McManigal and Carrie Raven, Applicants; David Lopez, Resident of <br />Riverview West Neighborhood; Lucy Linnaus, Senior Planner; Mike McCoy and Eileen Greene, <br />Police Department; Ryan Hodge, City Attorney; and Jocelyn Magalona, Recording Secretary. <br />Lucy Linnaus presented the staff report and recommendation for approval. <br />There were no written communications. <br />Mike McCoy noted Police Condition No. 15 and asked the applicants provide verification that the <br />parking and lighting is clean and operational. <br />Dave Lopez stated his opposition to the project and cited hearing both support and concerns from a <br />recent neighborhood association meeting. The Zoning Administrator noted the report indicated the <br />neighborhood association president had no concerns with the project. Mr. Lopez also noted his <br />concern for late night sales of alcohol and recent crime activity. Carrie Raven stated Wal -Mart has <br />an intensive employee training on alcohol sales and the register is programmed to automatically lock <br />to prevent selling alcohol after hours. <br />The Zoning Administrator asked if the conditions for CUP No. 2012 -05 are the same as CUP No. <br />2009 -06. Lucy Linnaus stated it is the same with the added Planning Condition No. 4 cancelling <br />CUP No. 2009 -06 upon approval of CUP No. 2012 -05. <br />Discussion was held regarding coin operated games and landscaping. Carrie Raven stated the coin <br />operated claw game that currently exists will get removed. Lucy Linnaus stated a missing tree within <br />the parking area will be corrected the next day. <br />The Zoning Administrator inquired if the applicants have read and agreed to the conditions of <br />approval. Carrie Raven stated their agreement to all the conditions. <br />The Zoning Administrator inquired as to calls for service. After a brief discussion, staff requested a <br />short recess. <br />The meeting recessed at 11:02 a.m. and reconvened at 11:09 a.m. with the same members present. <br />The Police Department requested a continuance in order to provide current crime statistics. <br />The Zoning Administrator continued Conditional Use Permit No. 2012 -05 as conditioned to March <br />28, 2012 at 10:30 a.m. City Hall Ross Annex Conference Room 2001. <br />The hearing adjourned at 11:15 a.m. <br />1 <br />Jocelyn Magalona <br />Recording Secretary <br />mrizalminutest2012 \3 -21 -12 CUP12 "05 Wal-Mart ABC.min <br />
