ZONING ADMINISTRATOR HEARING <br />MINUTES <br />APRIL 10, 2012 <br />CONDITIONAL USE PERMIT NO, 2012 -05 <br />10:05 a.m. <br />Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall Ross <br />Annex Conference Room 2001. <br />Also in attendance were: Brent McManigal, Carrie Raven, Richard Sanchez and Trevor Brown, <br />Wal -Mart Representatives; Lucy Linnaus, Senior Planner; Mike McCoy and Eileen Greene, <br />Police Department; Ryan Hodge, City Attorney; and Jocelyn Magalona, Recording Secretary. <br />Lucy Linnaus provided an update noting staffs recommendation change to denial due to the <br />above average reporting district. <br />Two written communications were received: the Santa Ana Chamber of Commerce in support of <br />Wal -Mart; and Dave Lopez in opposition to the ABC license upgrade. <br />The representatives from Wal -Mart provided background on the store's enhanced security, <br />training program and its partnership with neighboring businesses to deter theft and criminal <br />activity to maintain a safe shopping environment. Wal -Mart representatives also noted that they <br />do not sell alcohol after hours. Their registers are programmed to automatically lock to prevent <br />selling after hours and would continue that policy. <br />Discussion was held regarding the above average police calls for service in the area. It was <br />noted that a large percentage of the calls was for petty theft and non alcohol related. Wal -Mart <br />representatives noted that the higher number of calls for service was due to an increase in the <br />store's diligence to improve security. The Zoning Administrator noted the establishment is over <br />130,000 square feet and a 24 -hour operation. The Zoning Administrator inquired and the Police <br />Department noted that there were no calls for service related to alcohol. The Police Department <br />stated it did not want to discourage Wal -Mart from calling police for service in its vigilance in <br />deterring crime, and the Zoning Administrator agreed. Therefore, given these facts regarding <br />this property and operation, the Zoning Administrator disagreed in denying Wal- Mart's request <br />based on the above average police related incidents. <br />The Zoning Administrator noted the removal of the coin operated games from the store. <br />The Zoning Administrator inquired if the applicants agreed to the conditions as listed in the <br />March 21, 2012 staff report to which they stated their agreement. <br />The Zoning Administrator adopted a resolution voiding Conditional Use Permit No. 2009 -06 and <br />approving Conditional Use Permit No. 2012 -05 with conditions as listed in the March 21, 2012 <br />staff report. <br />The hearing adjourned at 10:31 a.m <br />Jocelyn Mag torte <br />Recording S :cretary <br />mf\za \minutes\2012W10 -12 CUP 12-05 Wal -Mart ABC.wn <br />
