ZONING ADMINISTRATOR HEARING <br />MINUTES <br />• <br />MAY 18, 2011 <br />CONDITIONAL USE PERMIT NO. 2011 -09 <br />10:45 a.m. <br />Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall <br />Ross Annex Conference Room 2001. <br />Also in attendance were: Paul Sepulveda, Josafat Zamora and Janet Jaramillo, <br />Applicants; Alex Vega, Committee Civico Mexico; Verny Carvajal, Senior Planner; Mike <br />McCoy, Police Department; Ryan Hodge, City Attorney; and Jocelyn Magalona, <br />Recording Secretary. <br />Verny Carvajal provided an update on the project and recommendation for approval <br />with conditions; and indicated the applicant's request to extend the hours of operation to <br />2:00 a.m. <br />There were no new written communications. <br />Mr. Vega stated his support of the project. <br />• The Police Department stated the floor plan needed to clearly identify the alcohol <br />storage dimensions; and reminded the applicants that the lighting standards inspection <br />be completed prior to issuance of the Letter of Approval to the Alcohol Beverage Control <br />Board. The Police Department also stated it does not support the applicant's request to <br />open until 2:00 a.m. <br />Discussion and clarification was held regarding amplified music and live entertainment. <br />The Zoning Administrator modified Police Condition No. 9 allowing juke box background <br />ambient noise that is not audible beyond 20 feet of the business. <br />The Zoning Administrator stated he is uncomfortable with the after -hours request and <br />reminded the applicants to establish a good track record. He noted the after -hours and <br />live entertainment can be reconsidered at the time of the six -month review by the <br />Zoning Administrator (Police Condition No. 22). <br />After explaining and clarifying the appeal process, the Zoning Administrator adopted a <br />resolution approving Conditional Use Permit No. 2011 -09 with modified conditions. <br />The hearing adjourned at 11:23 p.m. <br />r` <br />Jocelyn Magalona <br />Recording Secretary <br />mAza\minutes\2011 \5 -18 -11 CUP11 -09 MariscosABC.min <br />
