ZONING ADMINISTRATOR HEARING <br />MINUTES <br />NOVEMBER 2, 2011 <br />CONDITIONAL USE PERMIT NO. 2011 -09 <br />10:40 a.m. <br />Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall Ross <br />Annex Conference Room 2001. <br />Also in attendance were: Josefat Zamora, Janet Jaramillo and Paul Sepulveda, Applicants; <br />Verny Carvajal, Senior Planner; Yolanda Pena and Mike McCoy, Police Department; Lisa <br />Storck, City Attorney; and Jocelyn Magalona, Recording Secretary. <br />Verny Carvajal presented an update by providing pictures showing the window sign in <br />compliance. <br />There were no written communications <br />Sergio Klotz noted he received a call from Dave Lopez informing him that the window <br />signage has been removed. <br />Mr. Klotz recalled reminding the applicants in May 2011 that due to noncompliance with <br />conditions of approval at that time, condition modification was not granted; and they needed <br />to establish a good track record and then return in six months, complying with the current <br />conditions prior to requesting modification to the conditions; but are now before the Zoning <br />Administrator less than six months later and not in compliance. <br />Mr. Klotz noted the entertainment request is consistent with other ABCs throughout the City <br />but is not comfortable with the extended hours request citing written correspondence and <br />phone calls to staff not supporting the request and potential for issues due to the lack of <br />compliance with conditions and again recommended they establish a good track record. <br />Clarification was made regarding what is allowed with the modification to Police Condition <br />No. 9; and Paul Sepulveda stated they accept the decision. <br />Discussion followed regarding the appeal process. <br />The Zoning Administrator adopted a resolution approving an amendment to Police Condition <br />No. 9 allowing strolling musicians and karaoke to Conditional Use Permit No. 2011 -09. <br />The hearing adjourned at 11:05 a.m. <br />Jocelyn Magalo�ncf <br />Recording Secretary <br />mr\za \m1nmes\2011\11 -2 -11 CUP 11 -09 Manscos Zamora ABC.min <br />
