ZONING ADMINISTRATOR HEARING <br />MINUTES <br />JUNE 15, 2011 <br />CONDITIONAL USE PERMIT NO. 2011 -12 <br />10:38 a.m. <br />Mr. Vince Fregoso, Zoning Administrator, called to order the public hearing in the City Hall <br />Ross Annex Conference Room 2001. <br />Also in attendance were: Jennifer Chavez and Jason Austin, Walgreens; Ali Pezeshkpour, <br />Intern; Verny Carvajal, Senior Planner; Yolanda Pena and Mike McCoy, Police Department; <br />Ryan Hodge, City Attorney; and Jocelyn Magalona, Recording Secretary. <br />Verny Carvajal provided an update and recommendation for denial. <br />A letter was received from Joe Dixon from the Santa Ana Unified School District in <br />opposition to the project. <br />The Police Department stated an evaluation of Walgreen's ABC establishments in the cities <br />of Cypress, Garden Grove and Anaheim showed no administrative actions or red flags <br />related to alcohol sales. The Police Department was also satisfied with Walgreen's security <br />plan. <br />is ' <br />The Zoning Administrator stated he was satisfied with the Police Departments report and <br />will approve the project and authorize the Public Convenience and Necessity letter. <br />The Police Department provided a list of 21 conditions for approval along with two of the <br />Planning Department's conditions. Police Condition No. 13 was modified to reflect the <br />business can remain open until 11:00 p.m. Clarifications were given on Police Condition <br />Nos. 16, 17 and 21. The applicants were in agreement to all of the conditions. <br />The Zoning Administrator reviewed the findings of fact for approval with the following: that <br />the alcohol sales is a small part of Walgreen's business operation and will provide service <br />and product to the community; the project site is not located in a high crime area, the <br />research showed nothing out of the ordinary and Walgreens will provide an alcohol training <br />manual and program; it will help with the economic stability and will offer a similar playing <br />field with competitors; the conditions of approval will establish compliance; and the project <br />will not affect the General Plan. <br />The Zoning Administrator adopted a resolution approving Conditional Use Permit No. 2011- <br />12 with conditions. <br />The hearing adjourned at 10:58 a.m. <br />isJocelyn Ma 9 ' ona <br />Recording Secretary <br />mr\zoning administration \minutes \2011 \6 -15 -11 cup11 -12 Walgreens Grand&17`h.min <br />
