ZONING ADMINISTRATOR HEARING <br />MINUTES <br />is JUNE 15, 2011 <br />CONDITIONAL USE PERMIT NO. 2011 -13 <br />10:58 a.m. <br />Mr. Vince Fregoso, Zoning Administrator, called to order the public hearing in the City Hall <br />Ross Annex Conference Room 2001. <br />Also in attendance were: Jennifer Chavez and Jason Austin, Walgreens; Ali Pezeshkpour, <br />Intern; Verny Carvajal, Senior Planner; Yolanda Pena and Mike McCoy, Police Department; <br />Ryan Hodge, City Attorney; and Jocelyn Magalona, Recording Secretary. <br />Verny Carvajal provided an update and recommendation for denial. <br />A letter was received from Joe Dixon from the Santa Ana Unified School District in opposition <br />to the project. <br />The Police Department stated an evaluation of Walgreen's ABC establishments in the cities of <br />Cypress, Garden Grove and Anaheim showed no administrative actions or red flags related to <br />alcohol sales. The Police Department was also satisfied with Walgreen's security plan. The <br />Zoning Administrator stated he was satisfied with the Police Department's report. <br />The Police Department provided a list of 21 conditions for approval along with three of the <br />is Planning Department's conditions. Police Condition No. 13 was modified to reflect the <br />business can remain open until 11:00 p.m. The applicants were in agreement to all of the <br />conditions. <br />The Zoning Administrator stated he values the impact on the school. It was noted that <br />Walgreens has no signage advertising alcohol sales and the alcohol storage floor area <br />complies with the standards. It was also noted that coin operated games are prohibited in the <br />premises. <br />The Zoning Administrator reviewed the findings of fact for approval with the following: that the <br />alcohol sales is a small part of Walgreen's business operation and will provide service and <br />product to the community; the project site is not located in a high crime area, the research <br />showed nothing out of the ordinary and Walgreens will provide an alcohol training manual and <br />program; it will help with the economic stability and will offer a similar playing field with <br />competitors; the conditions of approval will establish compliance; and the project will not affect <br />the General Plan. <br />The Zoning Administrator adopted a resolution approving Conditional Use Permit No. 2011 -13 <br />with conditions. <br />The hearing adjourned at 11:05 a.m. <br />• Jocelyn Magalona <br />Recording Secretary <br />mr\zoning administration \minutes\2011 \6 -15 -11 cup11 -12 Walgreens Bristol &17` ".min <br />
