ZONING ADMINISTRATOR HEARING <br />MINUTES <br />• AUGUST 31, 2011 <br />CONDITIONAL USE PERMIT NO. 2011 -17 <br />11:13 a.m. <br />Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall <br />Ross Annex Conference Room 2001. <br />Also in attendance were: Jim Hammer, Paula Halverson and Norm Nowell, Applicants; Ali <br />Pezeshkpour, Planning Intern; Vince Fregoso, Principal Planner; Yolanda Pena and Mike <br />McCoy, Police Department; Ryan Hodge, City Attorney; and Jocelyn Magalona, Recording <br />Secretary. <br />Ali Pezeshkpour presented the staff report and recommendation for approval with <br />conditions. <br />There were no written communications. <br />Police Condition 14 was revised to amend the reference of "restaurant" to "establishment" <br />and Mike McCoy stated that the parking lot lighting must be brought up to code. Police <br />Condition 15 was modified to reference to Police Condition 14 prior to the issuance of a <br />Letter of Approval to the Alcohol Beverage Control Board. Police Condition 4 was also <br />modified to prohibit public telephones on the premises. <br />The applicants brought forward a proposal to conduct hard - liquor tastings in the future. <br />Discussion ensued as to which ABC license type would be appropriate for the applicant; a <br />Type 42 or Type 86, for on -site tastings. A short recess was granted to further look into the <br />new Type 86 ABC license and to allow the applicants' time to discuss the type of license <br />they require. <br />The meeting recessed at 11:51 a.m. and reconvened at 12:33 p.m. with the same members <br />present. <br />Further discussion was held regarding the inability to require the current property owner to <br />void the existing Conditional Use Permit No. 1985 -39 that permits alcoholic beverage sales <br />at the McFadden Avenue location. The Police Department expressed that leaving the <br />existing CUP and approving another one for the new location would result in an <br />overconcentration of licenses in the area. The deletion of Planning Condition 2 to void the <br />existing Conditional Use Permit No. 1985 -39 caused the Police Department to revise its <br />recommendation from approval to denial. <br />The Zoning Administrator continued Conditional Use Permit No. 2011 -17 to allow staff to re- <br />notice the public hearing, analyze the revised project, and modify the staff report <br />appropriately. <br />e hea-rigg adjourned at 12:43 p.m. <br />!Jocelyn agaIona <br />Recording Secretary <br />mr\za \minutes\2011 \8 -31 -11 CUP11 -17 Wine Club ABC.min <br />
