ZONING ADMINISTRATOR HEARING <br />MINUTES <br />SEPTEMBER 22, 2010 <br />CONDITIONAL USE PERMIT NO. 2009 -22 <br />10:37 a.m. <br />Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall <br />Ross Annex Conference Room 2001. <br />Also in attendance were: Maria Diaz and <br />Senior Planner; Mike McCoy and Yolanda <br />Magalona, Recording Secretary. <br />There were no written communications. <br />Citlaly Lepe, Applicants; Verny Carvajal, <br />Pena, Police Department; and Jocelyn <br />Verny Carvajal presented the staff report and recommendation. <br />Ms. Pena added conditions regarding the serving of alcohol by a waiter or waitress only, <br />the removal of graffiti within 24 hours or occurrence, the posting of a placard prohibiting <br />loitering, that Penal Code Section 602 is complied with at all times, and that the <br />premises may not be operated as a bar. <br />Ms. Pena modified Police Condition 18 by separating the review clause and the lighting <br />condition into two separate conditions. Mr. McCoy modified the parking reference in the <br />lighting condition to include the entire parking lot. He also stated that the lighting <br />standards be brought up to code prior to the issuance of Letter of Approval to the <br />Alcoholic Beverage Control Board. <br />Mr. McCoy cautioned the applicants that the business cannot operate as a banquet <br />facility or night club, nor can they operate past midnight. Mr. Klotz clarified the banquet <br />facility zoning. Ms. Lepe inquired if a permit is needed for a banquet facility. Mr. McCoy <br />stated a permit is required. Mr. Klotz stated that if they want to operate a banquet <br />facility in the future, they need to come back and go through a separate conditional use <br />permit process. <br />Ms. Pena asked for clarification of the proposed use of an area on the floor plan that <br />looked like a dance floor. Ms. Diaz said it is for non fixed tables and chairs. Mr. Klotz <br />asked if it was a dance floor and Ms. Lepe said no. <br />Mr. McCoy modified Police Condition 5 to not allow strolling musicians and karaoke on <br />the premises. He made clear that as the owner /manager of the restaurant it is their <br />responsibility to not allow it and to remove them or they would be in violation of the <br />condition. <br />Conditional Use Permit No. 2009 -22 <br />Page 1 of 2 <br />
