AMENDMENT TO NON- EXCLUSIVE AGREEMENT TO <br />PROVIDE CARNIVALS AT CITY PARKS <br />THIS AMENDMENT, made and entered into this 15`x' day of April, 2014 by Robert Acosta & <br />Associates (hereinafter "Promoter "), and the City of Santa Ana, a charter city and municipal corporation <br />organized and existing under the Constitution and laws of the State of California (hereinafter "City "). <br />RECITALS <br />A. On January 21, 2014, the City Council approved the Agreement for Promoter to promote <br />various park carnivals hereinafter referred to as "said Agreement ". <br />B. The parties desire to amend said Agreement to remove two (2) carnival events from <br />Promoter's events to promote. <br />NOW THEREFORE, in consideration of the mutual and respective promises set forth herein, and <br />subject to the terms and conditions hereinafter set forth, the parties agree as follows: <br />1. Section 3 of said Agreement shall be amended to remove the promotion of the carnivals at <br />Delhi Park (April 25 -27, 2014) and Rosita Park (May 9 -May 11, 2014). Promoter will only promote the <br />carnival at Cesar Chavez /Campesino Park (October 10 -12, 2014) <br />2. The total amount of fees Promoter shall pay to City shall accordingly be decreased to Four <br />Thousand Five Hundred Dollars ($4;500.00). <br />3. All other terms and conditions included in said Agreement shall remain unchanged and have <br />the same force and effect. <br />IN WITNESS WHEREOF, the parties hereto have executed this Amendment the date and year <br />first above written. <br />ATTEST: CITY OF SANTA ANA <br />MARIA D.
