<br />accordance with program regulations and the PHA policies, or must be given the opportunity to <br />lease in place if the terminated ineligible student members elect to move out of the assisted unit. <br /> <br />Death of the Sole Family Member \[24CFR 982.311(d) and Notice PIH 2010-9\] <br />The PHA must immediately terminate program assistance for deceased single member <br />households. <br />12-I.E. MANDATORY POLICIES AND OTHER AUTHORIZED TERMINATIONS <br />Mandatory Policies \[24 CFR 982.553(b) and 982.551(l)\] <br />HUD requires the PHA to establish policies that permit the PHA to terminate assistance if the <br />PHA determines that: <br /> <br />Any household member is currently engaged in any illegal use of a drug, or has a pattern of <br />illegal drug use that interferes with the health, safety, or right to peaceful enjoyment of the <br />premises by other residents <br /> <br />safety, or right to peaceful enjoyment of the premises by other residents <br /> <br /> in any drug- <br />related criminal activity <br /> <br />activity. <br /> <br />Use of Illegal Drugs and Alcohol Abuse <br /> SAHA Policy <br />member is currently engaged <br />in any illegal use of a drug, or has a pattern of illegal drug use that interferes with the <br />health, safety, or right to peaceful enjoyment of the premises by other residents. <br />SAHA will terminate assistance if any household membe <br />alcohol threatens the health, safety, or right to peaceful enjoyment of the premises by <br />other residents. <br />Currently engaged in is defined as any use of illegal drugs during the previous six months. <br />SAHA will consider all credible evidence, including but not limited to, any record of <br />arrests, convictions, or eviction of household members related to the use of illegal drugs <br />or abuse of alcohol. <br />In making its decision to terminate assistance, SAHA will consider alternatives as <br />described in Section 12-II.C and other factors described in Section 12-II.D. Upon <br />consideration of such alternatives and factors, SAHA may, on a case-by-case basis, <br />choose not to terminate assistance. <br /> <br /> <br />Page 12-4 <br />04/01/14 <br /> <br />
