Exhibit A SCOPE OF SERVICES Monserrat Alberto Provider shall conduct Ballet and Jazz for children & Adults, and Contemporary Dance for children age 16yrs - Adults A. Ballet & Jazz class will consist of monthly sessions, held 1 day per week, 1 hour per day- $28 per month. B. Contemporary Dance class will consist of monthly sessions, held 1 day per week, 1 hour per day- $28 per month C. Classes will be held throughout the year. D. Provider and City staff shall mutually agree upon a schedule for classes, including the location, specific days and hours when class will be held and holidays to be observed. E. Provider shall provide materials, supplies, equipment, records and personnel. Provider shall be responsible for cleanup of the facilities and materials and shall ensure the safety and effectiveness of instruction. F. If Provider allow others to teach his/her class, those teachers must be over 21, have obtained and maintain an instructor rating, and be covered by Provider's insurance. Provider shall provide City with documentation to verify compliance with instructor and insurance requirements. CLASS SIZE 1) Each class must have a minimum of 5 paid students and no more than a maximum of 20. 2) If the minimum registration has not been reached by the second class, the class may be cancelled by mutual agreement of Provider and City, without any compensation owed to Provider. 2) Provider will provide and be responsible for equipment, records, and personnel and clean up of the facilities and materials necessary to ensure the safety and effectiveness of said instruction. 3) If Provider allows others to teach his/her class, those teachers must be over 21, have obtained and maintain an instructor rating, and be covered by Providers' insurance. Provider shall provide City with documentation to verify instructor and insurance requirements. CLASS FEES 1) Each participant shall pay $28/monthly for each class. Provider will receive seventy percent (70%) of the total fees collected. City and Provider agree that City shall retain thirty percent (30%) of the fees collected as an administration fee. Compensation to Provider shall not exceed $25,000.00 per fiscal year. 2) The City shall collect registration from each participant during the registration period. Provider shall collect material fees, and shall refer all interested participants to City for registration. 3) Provider agrees that City is entitled to audit Provider's records and classes to insure compliance with this Agreement. 4) City shall prepare class rosters and provide a copy to Provider. Only registered participants may participate in class. 5). Provider agrees that City representative shall be entitled to audit Provider's records to insure compliance with this Agreement and that all participants are registered. 6). Provider may not waive class participation/registration fees. 7). City shall prepare class rosters and provide a copy to Provider. Only registered participants, listed on roster may participate in class.
