INSURANCC ON FILE <br />WURK MAY PROCEED N-2014 -048 <br />UNTIL, INSURANCE EXPIRES <br />q- (-/Y <br />CLERK O SWA4 <br />DATEt <br />AGREEMENT WITH CALIFORNIA BARRICADE RENTALS, INC. <br />sl), ,& Cuevas FOR PROVISION, INSTALLATION AND REMOVAL OF <br />TRAFFIC BARRICADES FOR CINCO DE MAYO EVENT <br />THIS AGREEMENT, made and entered into this 1' day of April, 2014 by and between <br />California Barricade Rentals, Inc. (hereinafter "Contractor "), and the City of Santa Ana; a charter city and <br />municipal corporation (hereinafter "City"), <br />RECTTALS <br />A. The City desires to retain a contractor having special skill and knowledge in the field of providing, <br />installing, maintaining, and removing traffic barricade equipment for special events such as the Cinco de <br />Mayo event that the City is hosting ( "Event "). <br />B. Contractor represents that Contractor is able and willing to provide such services to the City. <br />C. In undertaking the performance ofthis Agreement, Contractor represents that it is knowledgeable in this <br />field and that any services performed by Contractor under this Agreement will be performed in compliance <br />with such standards as may reasonably be expected from a professional consulting firm in the field. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the terms <br />and conditions hereinafter set forth, the parties agree as follows: <br />SCOPE OF SERVICES <br />Contractor shall provide, install, set -up, maintain and remove rented traffic barricade equipment <br />at 0 Street and 5'h Street and Broadway Avenue for the Event, as set forth in Exhibit A to this Agreement <br />(the "Equipment "). Contractor shall deliver the Equipment on Friday, May 2, 2014, and start setting up <br />immediately after the closure of the streets at 7:00 PM. Contractor will cleanup and remove the <br />Equipment on Sunday evening and have it completely removed and cleaned up by 6:00 AM, Monday, <br />May 5, 2014, with the exception of the carnival area which will be cleared by 5:00 PM on Monday, May <br />5,2014. <br />2. COMPENSATION <br />a. City agrees to pay, and Contractor agrees to accept as total payment for its services, the rates <br />and charges identified in Exhibit A. The contract award for such services pursuant to the Contractor's <br />Proposal shall not exceed Eight Thousand Dollars ($8,000.00). <br />b. Payment shall be made within thirty (30) days following receipt of proper invoice evidencing <br />work performed, subject to City accounting procedures. Payment need not be made for work which fails <br />to meet the standards of performance set forth in the Recitals which may reasonably be expected by City. <br />3. TERM <br />This Agreement shall commence on the date first written above and terminate on May 31, 2014, <br />unless terminated earlier in accordance with Section 12, below. The term of this Agreement may be <br />extended upon a writing executed by the City Manager and the City Attorney. <br />
