INSURANO5:ON FILYti A -2013 -171 <br />WORK MAY PROCEED <br />UNTIL, INSURANCE EXPIRES <br />�1 2 2.- 2691'.7 . <br />CLERK OF COUNCIL._ <br />RAPE: A 2'Z t SECOND AMENDMENT TO AGREEMENT <br />THIS SECOND AMENDMENT TO AGREEMENT is entered into on November 4, <br />2013, by and between Mariann Long and Associates, a sole proprietor ( "Consultant') and the <br />City of Santa Ana, a charter city and municipal corporation organized and existing under the <br />Constitution and laws of the State of California ( "City "). <br />RECITALS: <br />A. The parties entered into that certain Agreement # A -2011 -212, dated September 6, 2011, <br />(hereinafter "said Agreement') by which Consultant has provided energy efficiency, <br />sustainability and greenhouse gas emission reduction consulting services to assist the City in <br />developing an energy efficiency strategic plan. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to amend the <br />Scope of Services to provide for the implementation of additional components of the energy <br />efficiency agreement between the City and Southern California Edison. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all <br />the terms and conditions of said Agreement, except those amended in this First Amendment to <br />Agreement, the parties agree as follows: <br />L Section 1, SCOPE OF SERVICES, shall be amended to provide that, in addition to the <br />services previously agreed, Consultant shall provide the following services as set forth in <br />Exhibit A, attached hereto and incorporated by this reference: <br />a.) Consultant shall develop an Energy Action Plan, for energy efficiency strategies to be <br />implemented within the City facilities, setting forth goals and milestones to reach long <br />tern energy efficiency. <br />b.) Consultant shall provide reporting and deliverables related to the implementation of an <br />on -line permitting process which will allow residents and business to apply for limited <br />Planning & Building and Public Works permits. <br />2. Section 2.a, COMPE?NSATION, shall be amended to increase compensation by $32,705, to <br />pay for services set forth in section 1, above, on a milestone and deliverable basis, as set forth <br />in Exhibit A. <br />3. Section 4, TERM, shall be amended to extend the term through June 30, 2015, <br />4. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in <br />full force and effect. <br />11I <br />
