T. CONTRACTOR agrees to that it is in compliance with the Certification <br />Regarding Debarment ( "Exhibit F ") as required by the regulations implementing Executive Order <br />12549, Debarment and Suspension, 29 CFR Part 98, Section 98.510, Participants' Responsibilities. <br />The regulations were published as Part VII of the May 16, 1988, Federal Register (Pages 19160- <br />19211). <br />U. CONTRACTOR agrees to provide priority of services for veterans and eligible <br />spouses pursuant to 20 CFR part 1010 and the regulations implementing priority of service for veterans <br />and eligible spouses in Department of Labor job training programs under the Jobs for Veterans Act <br />published at 73 Fed.Reg. 78132 on December 19, 2008. <br />V. CONTRACTOR acknowledges that the official name for the statewide system <br />of providing employment and training through the WIA partnerships and various other local programs <br />is "America's Job Center ". To achieve the goals of this grant, it is important that the public has a quick <br />and easy method to identify that the projects or programs they are taking part in are part of the <br />"America's Job Center ". CONTRACTOR agrees to place the America's Job Center logo, in <br />accordance with the State of California guidelines for such use, on all public materials such as <br />statements, press releases, brochures, advertisements, reports and other documents describing projects <br />or programs funded in whole or in part with WIA funds. When the America's Job Center logo is used, <br />CONTRACTOR may accompany it with the following statement, "The (Program Name) is a proud <br />partner of the America's Job Center network ". CONTRACTOR shall not use the America's Job <br />Center logo in any manner that would imply that the State of California endorses a commercial <br />product, service or activity. <br />II. <br />CITY'S OBLIGATIONS <br />A. CITY agrees to pay to CONTRACTOR when, if and to the extent federal funds <br />are received under the provisions of the Act a sum not to exceed $136,400 for CONTRACTOR'S <br />performance in accordance with the Budget attached hereto as "Exhibit G" during the period of this <br />Agreement. Said sum shall be paid after CITY receives invoices submitted by CONTRACTOR as <br />provided hereinabove. <br />B. CONTRACTOR has the ability to adjust line item amounts in the budget with <br />the approval of the Executive Director, so long as the total Budget amount does not increase. <br />C. CITY agrees to provide for on -site monitoring reviews of said program <br />operation at least annually. In addition, monthly desk -top reviews of pertinent information will be <br />conducted. <br />D. CITY has the right to de- obligate the funds hereunder and take such funding back <br />from CONTRACTOR due to any of the following reasons: (a) lack of performance by <br />CONTRACTOR; (b) lack of fiscal accountability of CONTRACTOR; or (c) decrease in available <br />funding. <br />III. <br />TERM OF AGREEMENT <br />This Agreement shall commence on July 1, 2014 and all duties arising under this <br />Agreement shall have been performed by June 3Q,;01 he term of this Agreement may be extended <br />11 0 Page 5 of 15 <br />
