INTERGOVERNMENTAL SERVICE AGREEMENT <br />WRO- 96- IGSA -XXXX <br />I. Purpose: The purpose of this Intergovernmental Service Agreement is to establish a <br />formal binding relationship between the U.S. Department of Justice, Immigration & <br />Naturalization Service (INS) and the Santa Ana City Jail for the detention of persons <br />found to be in violation of the Immigration & Nationality Act and related criminal <br />statutes. The City shall retain the option to accept USINS detainees on a space <br />available basis. <br />II. The covered services: Include the housing, safekeeping, and subsistence of USINS <br />detainees in accordance with the contents of this agreement. The unit of service will <br />be the Detained Day, and the cost per unit is established by the City at $80.00 per <br />Detained Day. <br />III. Support, and Medical Services: The Contractor agrees to accept and provide for the <br />security, custody, care, and safekeeping of INS detainees in accordance with. state and <br />local laws, standards, policies, procedures and court orders applicable to the operation <br />of a detention facility. The Contractor agrees to provide INS detainees with the same <br />level of services and medical care provided local inmates. The Contractor will provide <br />all necessary security and transportation services when directed by the INS to move <br />detainees to medical or other facilities. <br />The Contractor further agrees to notify the INS as soon as possible of emergency <br />medical cases requiring removal of a detainee from the facility. Prior authorization shall <br />be obtained from the authorization officers, as listed in Section VII, or from the <br />undersigned Contracting Officer when removal is required for any medical services. <br />All costs associated with hospital or health care services provided outside the <br />Contractor's facility shall be invoiced separately, according to the provisions listed <br />under Section VII. <br />IV. Receiving and Discharging Detainees: In receiving or discharging USINS detainees <br />from the facility, the Contractor agrees to receive and discharge such detainees only to <br />and from persons presenting proper USINS credentials, except for medical or <br />emergency situations. USINS detainees sought for state or local court proceedings may <br />be made available only with the concurrence of USINS, which shall not be unreasonably <br />withheld. Juveniles may be placed in Foster Care, consistent with the normal placement <br />procedures and rate of the Department of Probation, with the written permission of the <br />USINS. Juveniles may also be released to family members, relatives and responsible <br />adult authorities with the written consent of the USINS. Written consent shall only be <br />authorized by individuals listed in section VII and may not include an increase in cost <br />per Detained Day. <br />
