On Monday, October <br /> 14,2013,I attended the Santa.Ana Planning Commission Hearing to provide my valid objections <br /> to agenda item number 4, The 301 Project as proposed by applicant and purported developer <br /> Ryan Ogulnick and his associate/partner, Robert Bisno. As required, I completed a Request to <br /> Speak Before Planning Commission Card ("Speaker Card"), after which I voiced concerns <br /> similar to those advanced by other attendees. <br /> When I contacted Planning Commission to ensure they retained my contact information <br /> and Speaker Card,Martha Ramirez advised me she had "gone through both files (ZOA/SPR)and <br /> did not locate [rny] speaker card." In speaking with Ms.Ramirez, she advised me that someone <br /> removed the card from the Planning Commission's files. I have reason to believe the <br /> individual(s) who removed my Speaker Card from the City's files was none other than <br /> Developer Ogulnick and/or his agents or representatives. If true, this would constitute a <br /> deliberate attempt by Developer Ogulnick to circumvent the City's measures for preserving its <br /> records inviolate, and an apparently successful effort by Developer Ogulnick to gain access to, <br /> and then alter, the City's files so as to erase certain evidence of my valid objections to his <br /> proposed project from the public record. <br /> Moreover, public records show that Developer Ogulniek and his representatives have <br /> been lavishing gifts and unreported benefits to the tune of hundreds of thousands of dollars on <br /> members of the Santa Ana City Council. This creates the clear appearance of a quid pro quo <br /> between the developer and the City of Santa Ana itself, in which the developer has been granted <br /> extraordinary access to the City's files and records in exchange for hundreds of thousands of <br /> dollars in payments and gifts,sonic of which have been unreported. It is particularly troubling, <br /> and quite simply not plausible, that an ordinary individual could remove information from the <br /> City's files with such ease. <br /> ra <br /> This theft of City property should not be tolerated, nor can the City of Santa Ana, or the <br /> City Attorney tolerate an applicant seeking to silence a speaker with valid objections by cutting <br /> the City off from contacting that individual (here, me), from being contacted by the Planning <br /> Commission or staff concerning comments and concerns raised regarding The 301 Project, <br /> ti. <br /> 1 <br />
