(b) Notification of . The City will transmit copies of all notices, orders, or <br />statements received from any governmental entity concerning violations or asserted violations <br />of Applicable Environmental Laws with respect to the Property and any operations conducted <br />thereon or any conditions existing thereon to the , and the City will notify the <br />in writing immediately of any release, discharge, spill, or deposit of any Hazardous <br />Substance that has occurred or is occurring that in any way affects or threatens to affect the <br />Property, or the people, structures, or other property thereon, provided that no such notification <br />shall create any liability or obligation on the part of the Assignees. <br />(c) Access for Inspection. The City will permit the Assignees, its agents, or any experts <br />designated by the Assignees to have full access to the Property during reasonable business <br />hours for purposes of such independent investigation of compliance with all Applicable <br />Environmental Laws, provided that the Assignees has no obligation to do so, or any liability for <br />any failure to do so, or any liability should it do so. <br />Section 5.13. City Consent to Assignment Agreements. The Authority's rights under this <br />Lease Agreement (excluding the right to receive notices, the right to reimbursement of costs and <br />to indemnification), including the right to receive and enforce payment of the Lease Payments, <br />and the Site and Facility Lease, are being assigned to the i n pursuant to the Assignment <br />Agreements. The City hereby consents to such assignment and to any additional assignment of <br />such rights by the Assignees or its assignees. The City agrees to execute all documents, <br />including notices of assignment and chattel mortgages or financing statements, which may be <br />reasonably requested by the Assignees or its assignees to protect their interests in the Property <br />and in this Lease Agreement. <br />-19- <br />
