neighborhoods in which medical marijuana collectives operate, and in providing <br />compassionate access to medical marijuana to its seriously ill residents. <br />NOW, THEREFORE, the City Council of the City of Santa Ana hereby finds, <br />determines and declares as follows that: <br />Section 1. The foregoing recitals are true and correct and are hereby <br />incorporated by reference. <br />Section 2. Submission of Ordinance. Pursuant to the requirements of laws <br />of the State of California, the City Council hereby orders the following proposed <br />ordinance to be submitted to the voters of the City of Santa Ana at the general <br />municipal election to be held on November 4, 2014: <br />"Shall the City of Santa Ana amend the Municipal Code to limit YES <br />the establishment of medical marijuana collectives/ <br />cooperatives in the City to only industrial zones, enforce strict <br />operating protocols, and impose a tax and regulatory fee upon NO <br />medical marijuana collectives /cooperatives as provided for in <br />Ordinance No. NS- 2864 ?" <br />Section 3. Text of Ordinance. The full text of the proposed ordinance to be <br />submitted to the voters is attached as Exhibit 1 (the "Ordinance ") hereto and shall be <br />made available to the public upon request. If a simple majority of the qualified voters <br />voting on the Measure vote in favor therefore, the Measure shall be deemed adopted <br />upon the City Council's declaration of the results of the election and effective 10 days <br />thereafter. <br />Section 4. Conduct of Election. The Clerk of the Council is authorized, <br />instructed and directed to procure and furnish any and all official ballots, printed matter <br />and all supplies, equipment and paraphernalia that may be necessary in order to <br />properly and lawfully conduct the election. In all particulars not recited in this <br />Resolution, the election shall be held and conducted as provided by law for holding <br />municipal elections. <br />Section 5. Notice of Election. Notice of time and place of holding the <br />election is hereby given, and the Clerk of the Council is authorized, instructed and <br />directed to five further or additional notice of the election, in time, form and manner as <br />required by law. <br />Section 6. Impartial Analysis. Pursuant to Elections Code section 9280, the <br />City Council hereby directs the Clerk of the Council to transmit a copy of the ordinance <br />to the City Attorney. The City Attorney shall prepare an impartial analysis of the <br />ordinance, not to exceed 500 words in length, showing the effect of the ordinance on <br />Resolution No. 2014 -XXX 55D -35 <br />Page 2 of 2 <br />
