ARTICLE II - DISPOSITION OF THE PROPERTY <br />Section 201. Lease of the Property <br />The City has entered into aground lease with Delhi, in accordance with, and subject to, all <br />of the terms, covenants and conditions of the Lease, attached hereto and incorporated herein, as <br />Attachment "C." <br />Section 202. Additional Requirements for Conveyance of Leasehold Interest <br />It is the responsibility of Delhi, in collaboration with the City, to obtain any additional <br />construction loans, grants or any other funding needed to further develop the Community Center, <br />and have any and all mortgages, deeds of trust, or other security instruments by which the Property <br />or any part thereof is made security for said loan or loans duly executed and available for <br />recordation. <br />Section 210. Possession of the Property <br />Possession of the leasehold property shall be deemed delivered by the City to Delhi at the <br />time the leasehold interest in the Property is conveyed and recorded with the County Recorder's <br />Office. The City shall deliver possession of the leasehold interest to Delhi free of any possession or <br />right of possession by a third party, except that of the Delhi, unless waived by Delhi in writing. <br />
