• BAER <br />PREPARED BY <br />DATE <br />SUBJECT <br />D.. i...H+ r r- k <br />10/30/79 PHONE <br />LICENSE AGREEMENT BETWEEN <br />RANCHO SANTIAGO COMMUNITY <br />COLLEGE DISTRICT AND CITY OF <br />DATE OF COUNCIL ACTION // `` 7? <br />Approve the License Agreement for the establishment of a Career Education Center at <br />Centennial Urban Regional Park <br />BACKGROUND <br />On May 16, 1979 the Mayor, Director of Recreation and Parks, Deputy City Attorney Drosman <br />and Dr. Armstrong of Rancho Santiago Community College District (RSCCD) met with <br />representatives of Heritage Conservation and Recreation Service (HCRS), Department of <br />Interior to review the proposed License Agreement. Approval by HCRS is required per the <br />deed restrictions placed on the property by the federal government when the City received same. <br />Following extensive discussion, several changes were made at the request of HCRS and the <br />Agreement was resubmitted for their approval. They approved same in its entirety with one <br />slight addition -- Paragraph C, Assignment - page 8, add the phrase "and the Secretary of <br />the Interior" at the end. <br />Approval was then secured from the President of RSCCD. <br />SIGNIFICANT POINTS IN AGREEMENT <br />1. City grants license to RSCCD to use the property described in "Exhibit D" - 1.76 acres - <br />for a period of 30 years. <br />2. Renewal for an additional term or terms of five (5) years each is provided. <br />3. Scope of project includes: construction of 5 wood frame and air - conditioned structures <br />for child care and classrooms, shade structure; sidewalks; vending machine enclosures; <br />landscaping; parking lot for 198 cars and a paved access road. <br />4. RSCCD agrees to maintain exterior of all facilities, all ground and landscaped areas <br />within portion identified as "Exhibit D ". <br />5. Facilities shall be fully compatible with City and County of Orange recreational program <br />and planned development of Centennial Park. <br />6. Ultimate control and responsibility for development, operation and maintenance shall <br />remain with City and County. <br />7. RSCCD will pay City water main, drainage, and sewer assessment fees amounting to $14,000 <br />at time of execution of this Agreement. <br />8. RSCCD will pay City 7.4% of operation and maintenance expenses incurred by City and <br />County in "common areas" of park, but not less than $10,000 per year. Common areas is <br />defined as land which City is obliged to operate and maintain. <br />9.
