Conditional Use Permit No. 2014 -10 <br />June 9, 2014 <br />Page 3 <br />ProiectBackaround <br />The subject site is part of a 9.8 -acre, three parcel development that is located within the former Hutton <br />Center development that was entitled in 2005. The entitlements allowed three 25 -story high -rise <br />towers, a six -story mid -rise residential /office building, and 14,000 square feet of retail and restaurant <br />uses that was modified in 2009 to allow a Courtyard by Marriott hotel. Two of the high- rise towers, the <br />349 -unit Skyline Towers at 9 and 15 MacArthur Place, were completed in October 2008, The <br />development formerly approved on this site, The Montage by Integral Development, was purchased by <br />Lyon Communities and re- entitled in 2011. Occupancy of the first 70 units of The Marke began in May, <br />2014. The remaining 230 units were recently released for occupancy, with move -ins scheduled to <br />begin shortly. <br />General Plan and Zonina Consistencv <br />The General Plan land use designation for the site is District Center (DC), which allows for major <br />development sites such as the mufti - family residential development and ancillary uses such as <br />alcoholic sales licenses. District Centers are designed to serve as anchors to the City's commercial <br />corridors, and to accommodate major development activity. The project site and proposed use is <br />consistent with this General Plan land use designation. <br />The zoning for the site is Specific Development No. 76 /MacArthur Place South Mixed Use District <br />(SD -76). The SD -76 designation is a mixed use zone that allows office, restaurant, retail, hotel and <br />residential land uses. The zoning designation also allows uses such as alcoholic sales licenses, <br />making the proposed use consistent with the zoning designation. <br />Project Analysis <br />Conditional Use Permit requests are governed by Section 41 -638 of the SAMC. Conditional Use <br />Permit requests may be granted when it can be shown that the following can be established: <br />• That the proposed use will provide a service or facility which will contribute to the general well <br />being of the neighborhood or community. <br />• That the proposed use will not, under the circumstances of the particular case, be detrimental to <br />the health, safety, or general welfare of persons residing or working in the vicinity. <br />• That the proposed use will not adversely affect the present economic stability or future economic <br />development of properties surrounding the area. <br />• That the proposed use will comply with the regulations and conditions specified in Chapter 41 for <br />such use, <br />• That the proposed use will not adversely affect the General Plan of the city or any specific plan <br />applicable to the area of the proposed use. <br />31A-5 <br />
