Medical Marijuana Ballot Initiative <br />July 1, 2014 <br />Page 5 <br />o (1) Senior Office Assistant <br />o (2) Assistant City Attorneys <br />o (1.5) Combination Building Inspector <br />o (4) Vice Unit Police Officers <br />California Environmental Quality Act (CEQA) Analysis <br />The California Resources Code states that voter initiatives not sponsored by a public agency do <br />not constitute a "project' pursuant to CEQA and, as such, they are exempt from environmental <br />review (Public Resources Code Section 15378(b)(3)). The collective- backed voter initiative, <br />therefore, is not required to provide any environmental impact analysis. In contrast the City - <br />sponsored initiative is subject to CEQA review. <br />Therefore, in accordance with this requirement, staff reviewed the Environmental Checklist Form <br />(Appendix G of the CEQA Guidelines) to determine if there would be any possibility that the City - <br />sponsored initiative would have the possibility of creating any environmental impacts. Based on <br />this review, staff has determined that the establishment of regulations for medical marijuana <br />collectives does not meet any of the thresholds contained in the Checklist that would trigger an <br />environmental impact. According to the "general rule exemption" (Section 15061(b)(3)) of the <br />CEQA Guidelines, projects which have no potential for causing a significant effect on the <br />environment are not subject to CEQA. No further environmental analysis is required. A notice of <br />exemption will be filed for this project. <br />FISCAL IMPACT <br />The cost to consolidate the General Municipal Election is estimated to be $225,000.
