My office represents several <br />seriously ill and/or disabled individuals who are members of medical marijuana collectives <br />located in Santa Ana, California. <br />On June 17, I wrote to you and Council members regarding infirmities in the draft <br />language proposed for a City-based medical marijuana ballot measure discussed by the <br />Council during the meeting held that date. I included exhibits with that letter including <br />highlights of areas in the proposed measure that were clearly defective. <br />I am including with this letter: 1) a copy of an Editorial written by the editorial staff <br />of the Orange County Register newspaper, and 2) a copy of the Advocates for the Disabled <br />and Seriously Ill Model Medical Marijuana Ordinance. I wrote the model ordinance and <br />have vetted it to ensure it is free from issues with federal preemption, compelled <br />incrimination and discrimination. Moreover, the model ordinance balances the needs of the <br />seriously ill and disabled with the important health, safety and welfare responsibilities of <br />the City. <br />You'll note the part in the editorial in the Register that provides, "Instead, the <br />Council should remove the arbitrary cap and allow dispensary locations within reasonable <br />boundaries, like far from schools and parks, throughout the City." The article is referring <br />to the arbitrary 12- dispensary cap included in your draft. In my letter on the 17a`, I <br />explained that such arbitrary caps violate the California Disabled Persons Act. While there <br />
