On the enactment date of this Chapter, any administrative or criminal <br />actions filed and pending against a Managing Member, member, Qualified <br />Caregiver, or Medical Marijuana Collective for violation of any current or former <br />provision of this Code where such violation related solely to operating a Medical <br />Marijuana Collective, shall be dismissed. A person convicted under any <br />provision of this Code for operating or participating in a Medical Marijuana <br />Collective, Dispensary, or Cultivation Site shall have the right to move to set <br />aside such conviction and any penalty assessed or sentence imposed <br />thereunder and such conviction shall be set aside by the Court. <br />D. On the enactment date of this Chapter, any unpaid fines assessed, <br />whether civil, administrative, or criminal, against a Managing Member, member, <br />Qualified Caregiver, or Medical Marijuana Collective for violation of any current or <br />former provision of this Code resulting solely from operating a Medical Marijuana <br />Collective in the City, shall be waived. An individual who or entity that has paid a <br />fine or fee under this Code for operating or participating in a Medical Marijuana <br />Collective, Dispensary, or Cultivation Site shall have thirty (30) days following <br />enactment of this Chapter to apply for a refund of such fines or fees. An <br />application for refund shall be made in writing on the City's then effective refund <br />request form and shall include documentation showing payment of any amount <br />claimed. Within sixty (60) days of submission of a completed refund application <br />and verification of fine or fee payment claimed, the City shall refund the fine or <br />fee to the claimant. <br />E. On the enactment date of this Chapter, any unpaid fines assessed, <br />whether civil, administrative, or criminal, against a landlord of any medical <br />marijuana collective, dispensary, cultivation site, or business for violation of any <br />21 <br />04202014 -RE V30 <br />
