INSURANCE NOT REQUIRED <br />MIRK MAY VRWFF0 <br />DATA; <br />CONSULTANT AGREEMENT <br />C5: SA'PDCZ) THIS AGREEMENT, made and entered into this 1st day ofJuly, 2014 by and between Norman, <br />Knispel, an individual, (hereinafter, "Consultant "), and the City of Santa Ana, a charter city and municipal <br />corporation organized and existing under the Constitution and laws of the State of California (hereinafter <br />�) City "). <br />A <br />RECITALS <br />A. The City desires to retain a consultant having special skill and knowledge in the field of <br />conducting administrative hearings. Consultant represents that it is able and willing to provide <br />such services to the City. <br />B. In undertaking the performance of this Agreement, Consultant represents that it is <br />knowledgeable in its field and that any services performed by Consultant under this Agreement <br />will be performed in compliance with such standards as may reasonably be expected from a <br />professional consulting firm in the field. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the terms <br />and conditions hereinafter set forth, the parties agree as follows: <br />SCOPE OF SERVICES <br />Consultant shall conduct administrative hearings and mediation. for the Santa Ana Police <br />Department and any other City agency or Department on an as needed basis in a competent fashion and <br />mooting the standard of care which is reasonable in the industry. The administrative hearings shall be <br />conducted for violations of the Santa Ana Municipal Code including but not limited to Chapters 5,10, 17 <br />and 31 and handled in accordance with the provisions of Chapter 3 of the Municipal Code where <br />applicable, Consultant is to use his own independent judgment and discretion in conducting the <br />administrative hearings. <br />2. COMPENSATION <br />This Agreement shall be for an amount not to exceed three thousand dollars ($3,000) for each of <br />the three years for a total amount not to exceed nine thousand dollars ($9,000). The services shall be <br />provided at the rates of seventy -five dollars ($75) a hearing when there is one hearing and fifty dollars <br />($50) a hearing when there is more than one hearing on a single day. <br />3. TERM <br />This Agrcement shall commence on the date first written above and terminate on June 30, 20 t 7, <br />unless tern- iinated earlier in accordance with Section 11, below. <br />4. INDEPENDENT CONTRACTOR <br />Consultant shall, during the entire term of this Agreement, be construed to be an independent <br />contractor and not an employee of the City. This Agreement is not intended nor shall it be construed to <br />create an employer - employee relationship, a joint venture relationship, or to allow the City to exercise <br />discretion or control over the professional manner in which Consultant performs the services which are <br />the subject matter of this Agreement; however, the services to be, provided by Consultant shall be <br />
