City has moratorium but we don't have control over <br />court process including appeals. <br />Councilmember Martinez asked about police authority. <br />Councilmember Benavides, agree wth need for enforcement plan; opined <br />that negative element brought by establishments; present for <br />consideration is to provide voters with option to have a ban; City not <br />banning medical marijuan, but only allow in clinics and medial facilities. <br />separation of daycare and community centers be included in proposed <br />language; churches and commnity centers are alerady included in <br />proximity <br />Mayor Pulido suggested churches <br />distance from Collective /Cooperative <br />in the future, if possible. <br />and parks be included in 600 feet <br />. Request that City Council consider <br />FRIENDLY AMENDMENT by Reyna to change distance between <br />Collective /Cooperative to 800 feet. <br />Mayor Pro Tern Tinajero concerned that due diligence not performed <br />on new proposed distance. Regulations can be amended in the <br />future, if measure approved. <br />SUBSTITUTE MOTION by Benavides, seconded by Reyna to place <br />City's initiative as proposed and include another measure to ban <br />establishments for voter's to consider all of their options. <br />Motion failed 2 -5 (Martinez, Sarmiento, Tinajero, Pulido, and <br />Amezcua dissented). <br />MOTION: Approve staff recommendation with following revisions to <br />proposed ordinance: remove cap on number of allowed businesses, <br />reduce hours of operation, reduce separation between Collectives to <br />500 feet, reserve right to amend ordinance in the future by the City <br />Council, replacement of Conditional Use Permit with a Safety <br />Regulatory Permit, approve a lottery selection process, remove <br />testing requirement and allow only M1 and M2 zones: <br />1. Adopt resolutions. <br />a. RESOLUTION NO. 2014 -037 - A RESOLUTION OF THE CITY <br />COUNCIL OF THE CITY OF SANTA ANA CALLING FOR AND <br />GIVING NOTICE OF A GENERAL MUNICIPAL ELECTION TO BE <br />HELD IN THE CITY OF SANTA ANA ON NOVEMBER 4, 2014 <br />FOR SUBMISSION TO THE VOTERS OF A BALLOT MEASURE <br />RELATING TO THE ESTABLISHMENT, OPERATION AND <br />TAXATION OF MEDICAL MARIJUANA COLLECTIVES AND <br />CITY COUNCIL MINUTES 9 JULY 1, 2014 <br />1 0A -9 <br />
