Although the original application was from Edward Padilla and Integrity Builders, the Density Bonus Agreement approved by the City Council included a provision in section 11 that states, "This Agreement shall be binding upon and shall inure to the benefit of Owner and Santa Ana and their respective successors and assigns." Integrity Builders lost the property and it was purchased by Samuel Pham. According to the new Density Bonus Application recently submitted to Planning, Samuel Pham and Sam Construction & Builder Corp. are the new property owner and authorized agent for the density bonus project. They have represented that they will be building the same project that was previously proposed by and approved for Integrity Builders. Since they are a successor owner to the property and will be building the same project, it has been determined that the Density Bonus Agreement previously approved by City Council should be binding upon them and inures to their benefit.
