NS -2866 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA AMENDING SECTION 14 -55 <br />OF ARTICLE II OF CHAPTER 14 OF THE SANTA <br />ANA MUNICIPAL CODE REGARDING A CHANGE <br />IN OPERATING HOURS OF SAFE AND SANE <br />FIREWORKS STANDS ON THE FOURTH OF JULY <br />THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES <br />ORDAIN AS FOLLOWS: <br />Section 1. Adoption of this Ordinance is exempt pursuant to general rule <br />that the California Environmental Quality Act applies only to projects that have the <br />potential for causing a significant effect on the environment in accordance with <br />Section 15061 (b) (3) of the Guidelines. Approval of this Ordinance granting one <br />additional hour of sales from 8:00pm until 9:00pm will not have a significant effect <br />on the environment because the action will not result in or lead to a physical <br />change. <br />Section 2. Section 14 -55 of Article II of Chapter 14 of the Santa Ana <br />Municipal Code is hereby amended to read as follows: <br />Sec. 14 -55. Sale of safe and sane fireworks; hours of sale. <br />No person shall display, sell, or engage in the business of selling safe and <br />sane fireworks without first having obtained a permit to do so as hereinafter <br />provided. No person shall sell any type of fireworks at any time except from <br />12:00 noon through 10:00 p.m. on July 1st; from 10:00 a.m. through 10:00 p.m. <br />on July 2nd and 3rd; and from 10:00 a.m. through 9:00 p.m. on July 4th of any <br />year. <br />Section 3. If any section, subsection, sentence, clause, phrase or portion of <br />this ordinance is for any reason held to be invalid or unconstitutional by the decision <br />of any court of competent jurisdiction, such decision shall not affect the validity of <br />the remaining portions of this ordinance. The City Council of the City of Santa Ana <br />hereby declares that it would have adopted this ordinance and each section, <br />subsection, sentence, clause, phrase or portion thereof irrespective of the fact that <br />any one or more sections, subsections, sentences, clauses, phrases, or portions be <br />declared invalid or unconstitutional. <br />Ordinance No. NS -2866 <br />Page 1 of 2 <br />
