ARTICLE III <br />3.0 IMPLEMENTATION <br />3.1 The parties agree that this Memorandum of Understanding shall not be <br />binding upon the parties until said City Council: <br />A. Acts, by majority vote, to formally approve said Memorandum of <br />Understanding; and <br />B. Acts to appropriate the necessary funds required to implement the <br />provisions of this Memorandum of Understanding that require funding. <br />3.2 Notwithstanding the foregoing, in the event the City Council fails to take all <br />actions necessary to implement this Memorandum of Understanding in a <br />timely manner, the parties understand that they may mutually agree to <br />implement appropriate provisions of this Memorandum that do not require <br />specific approval by the City Council. <br />3.3 Implementation shall be effective as of the date the memorandum of <br />understanding is formally approved by the City Council. If the parties fail to <br />agree to implement provisions of this Memorandum not requiring City <br />Council approval, then negotiations shall resume upon the request of either <br />party. <br />CONFIDENTIAL ASSOCIATION OF SANTA ANA (CASA) M14015 Page 6 <br />
