Amendments to Employment Agreements for City Manager, <br />City Attorney, and Clerk of the Council <br />September 2, 2014 <br />Page 3 of 3 <br />process for the City Manager and City Attorney, the City Council approved an employment <br />agreement delineating the terms and conditions of Ms. Huizar's continued appointment to <br />the position. The proposed amendment to employment agreement prepared by the City <br />Attorney's office, a copy of which is attached, includes the following new provisions: <br />City agrees to combine deferred compensation into base salary. Proposed <br />change will require deletion of Section 2.2.1 Deferred Compensation in <br />Agreement to be consistent with other Executive Managers. <br />The City Council shall review and discuss Clerk of the Council's annual <br />performance in or around July of each year and shall be eligible for <br />Management Performance Based Salary Adjustments, same as Executive <br />Management. <br />• City agrees that Clerk of the Council will be eligible for payment for unused <br />sick leave, same as provided to Executive Management. <br />STRATEGIC PLAN <br />Approval of this item supports the City's efforts to meet Strategic Plan Goal No. 7 Team Santa <br />Ana, Objective No. 4, Establish employee compensation that attracts and retains a highly <br />qualified workforce. <br />FISCAL IMPACT <br />Funds are available in the City Manager's Office account for compensation and benefits (account <br />no. 01103010 - various); City Attorney's Office and other departmental contractual services <br />(account no. various - 62300); and the Clerk of the Council Office account for compensation and <br />benefits (account no. 01107031 - various) for $1,852 in Fiscal Year 2014 -2015, and $12,206 will <br />be budgeted in Fiscal Year 2015 -2016. <br />Edward 5y <br />Executive Director <br />Personnel Services <br />APPROVED AS TO FUNDS AND ACCOUNT: <br />Francisco Gutierrez <br />Executive Director <br />Finance & Management Services Agency <br />Attachments: Exhibit 1 — Amendment to the City Manager Employment Agreement <br />Exhibit 2 — Professional Services Agreement for City Attorney Services <br />Exhibit 3 — Amendment to Clerk of the Council Employment Agreement <br />25E -3 <br />
