ZoI4 • + PERFORMANCE AGREEMENT WITH MARISA RONDSTAT- MENDOZA N- 2014 -118 THIS PERFORMANCE AGREEMENT made and entered into this,:�5raay of August, 2014 by and between Marisa Ronstadt- Mendoza , a sole proprietor (hereinafter "Performer "), and the City of Santa. Ana, a charter city and municipal corporation organized and existing under the Constitution and laws of the State of California (hereinafter "City "). RECITALS A. The City desires to retain a performer having special skill and knowledge in the field of providing singing performance services. B. Performer represents that she is able and willing to provide such service to the City. C. In undertaking the performance of this Agreement, Performer represents that it is knowledgeable in its field and that any services performed by Performer under this Agreement will be performed in compliance with such standards as may reasonably be expected from a professional consulting firm in the field. NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the terms and conditions hereinafter set forth, the parties agree as follows: 1. SCOPE OF SERVICES Performer shall conduct a singin performance for the Fiestas Patrias event ( "Event ") to be held in downtown Santa Ana at the 4t Street and Sycamore Stage on Saturday, September 13, 2014, from b PM -7 PM, and she will sing the National Anthem after 8 PM at the 411' Street and Minter stage, as set forth in the Performer's Scope of Work, attached hereto and incorporated herein as Exhibit A. 2. COMPENSATION City agrees to pay, and Performer agrees to accept as total payment for her services, the rates and charges identified in Exhibit A. The total sum to be expended under this Agreement shall not exceed One Thousand Five Hundred Dollars (9;1,500.00) payable on the day of the Event so long as this Agreement is fully executed and an invoice has been received in the Parks Recreation & Community Services Administration Office ten (10) working days prior to Event date. Payment need not be made for work which fails to meet the standards of performance set forth in the Recitals which may reasonably be expected by City. 3. TERM This Agreement shall commence on the date stated above and terminate on September 30, 2014, unless terminated earlier in accordance with Section 12, below. The Term of this Agreement may be extended by a writing executed by the City Manager and the City Attorney.
