INSURANCE NOT ON FILE <br />WORK MAY NAT PROCEED <br />CLERK OF COUNCIL <br />DATE: 3 1 1011 <br />N- 2014 -110 -001 <br />a: yv5n eF ti ` FIRST AMENDMENT TO DEPOSIT AGREEMENT WITH <br />BOBBY NAVA ADVERTISING AND ENTERTAINMENT AGENCY <br />")1441 THIS FIRST AMENDMENT TO DEPOSIT AGREEMENT made and entered <br />into this ,Apt' day of August, 2014, by and between Bobby Nava Advertising and <br />Entertairmenf Agency, a sole proprietorship (hereinafter "Consultant "), and the City of <br />Santa Ana, a charter city and municipal corporation organized and existing under the <br />Constitution and laws of the State of California (hereinafter "City "). <br />RECITALS <br />A. The parties entered into that certain Deposit Agreement ( #N- 2014 -110) dated <br />August 18, 2014 (hereinafter "Deposit Agreement'), by which Consultant is <br />providing advertising and entertainment services for the Fiestas Patrias event <br />to be held in downtown Santa Ana with performers on Saturday, September <br />13 and Sunday, September 14, 2014, <br />B. The parties wish to amend said Deposit Agreement to increase the <br />compensation for additional talent to be provided during the event. <br />WHEREFORE, in consideration of the covenants contained in said Deposit Agreement, <br />and subject to all the tennis and conditions of said Deposit Agreement, except those <br />amended in this First Amendment to Deposit Agreement, the parties agree as follows: <br />1. Section 1, SCOPE OF SERVCIES, shall be amended to add another performer and <br />timeframe for service as set forth in the Consultant's Talent Contract, attached hereto <br />and incorporated herein as Exhibit A. <br />2, Section 3, COMPENSATION, shall be amended to increase the total compensation <br />under said Deposit Agreement by nine thousand dollars ($9,000), for a total sutra not <br />to exceed twenty -five thousand dollars ($25,000) during the teen of said Deposit <br />Agreement. This increase shall be for the added talent documented in Exhibit A, as <br />well as contingencies- Again, City shall pay half of the total additional compensation <br />due under this First Amendment to Deposit Agreement for the added talent upon <br />execution of this First Amendment to Deposit Agreement, and the remaining <br />compensation shall be paid on the final day after performance, September 14, 2014, <br />subject to City accounting procedures, <br />3. Except as hereinabove amended, all teens and conditions of said Deposit Agreement <br />shall remain in full force and effect. <br />I //1 <br />III <br />
