JDK:bc: 10/10/88 <br />credit to RETAILER of ten dollars ($10.00) shall be adjusted <br />annually in accordance with the Consumer Price Index <br />published by the United Stated Department of Labor for the <br />Long Beach - Santa Ana - Anaheim metropolitan area. This <br />annually adjusted credit to RETAILER shall serve as full and <br />adequate -compensation to RETAILER for the costs incurred by <br />RETAILER in assuming ownership of, servicing, maintaining and <br />reading the Project Water meter for each Groundwater Customer <br />in the same manner that RETAILER would for a customer service <br />meter attached to its potable water system, and for providing <br />to the Groundwater Customers those customer services <br />functions provided by RETAILER to Project Customers pursuant <br />to paragraph 4.3 hereinabove. <br />6.5 In the event either that a Groundwater Customer <br />abandons its groundwater production facility or that OCWD <br />determines that a Groundwater Customer is no longer capable <br />of producing groundwater for its landscape irrigation needs, <br />OCWD shall have the exclusive authority and discretion, <br />without the necessity of amending this Agreement, to remove <br />such water user from the designation of "Groundwater <br />Customers."' In such event, the former Groundwater Customer <br />shall be treated as a Project Customer for all purposes <br />hereunder, including but not limited to the retail sale of, <br />and billing and payments for, Project Water. <br />SECTION SEVEN: INDEMNITY AND INSURANCE <br />7.1 OCWD shall save RETAILER harmless from and against <br />and shall indemnify RETAILER from any liability, loss, costs, <br />
