and construction of the Project and all modifications thereof. <br />ocWD shall be responsible for all capital costs. <br />Section 5: Ownership of Facilities. <br />OCWD shall be the sole and exclusive owner of all <br />Project facilities, except for metering devices which shall be <br />owned by the local retail water purveyors, and Project <br />facilities that may be installed within the boundaries of End <br />Users' properties. MWD, Cam, MWDOC, and SA shall have no <br />ownership right, title, security interest or other interest in <br />any Project facilities, nor any rights, duties or <br />responsibilities for construction, operation, and maintenance <br />thereof. The sole right and obligation of MWD shall be in the <br />form of an entitlement to purchase the Actual Yield generated <br />by the Project, and to sell the Actual Yield as set forth in <br />Sections 7 and 8 hereof. <br />Section 6: Operating Responsibilities. <br />6.1: OCWD shall be solely responsible for the <br />operation and maintenance of all facilities of the Project, <br />including obtaining wastewater effluent from the CSDOC Plant <br />No. 1 as a supply for this Project, providing tertiary <br />wastewater treatment, and for distribution and delivery of <br />Reclaimed Water to the site of each End User. <br />OCWD shall provide metering devices, to be owned, <br />operated, and maintained by local retail water. purveyors, for <br />the purpose of measuring the quantity of Actual Yield delivered <br />to each End User; provided, however, that OCWD shall be <br />
